fortunately, only minimal damage to both
the boat's windshield frame has some damage
and the truck is dented and scratched up pretty good

Wow, what a bummer. Is your neighbor gonna step up and take care of it for you? Nice setup by the way, do you have any pre-arbor day pics?

I guess the tree was taken by some weather, but mostly due to no/poor trimming....too much weight

Sorry to say, but in most cases his insurance won't pay. It will be up to your homeowners.

They call that an act of God.

Anyway that is how it is in Alabama.

The only way it could fall on his insurance company is that the guy next door had been warned about the tree being unstable or unsafe.

They should pay. We had a hail storm that caused damage to all kinds of stuff on dad's house & it paid for all of it - new roof, windows, & gutters. The stucco was okay so he didn't worry about it. I don't wee why they wouldn't cover it. If nothing else, yours should.

My neighbors shack burned down with my boat parked in between the houses. My insurance took care of the damages, not the neighbors.Upload

Jory,

Who paid? Your neighbor's insurance or yours?

In most cases when a tree falls, (no matter whos land it is on) it is up to your insurance to cover the damage.

great point on the insurance
we'll see what happens
I would bet that neighbor will honor the cost...even if out of pocket

also, I know that lots of people don't feel this way, but......if the scratches dont completely come out of the truck, I can't see making him pay to repaint what will probably be the whole truck
although it is a nice truck, it's still a truck
...and somewhat of a work-truck at that

the boat on the otherhand....well....that will get put back to perfect (no matter who pays)

thanks for everyones input

Cliff,
Once you deductible is met, I would have my insurance company fix every thing.

A good thing for him to offer is to pay your deductible.

But he does not have to.
