Trim tabs have been round forever. It's up to you how you want to mount them. No body can enforce the way you install an off the shelf product. I say give it ago.

A patent protects an inventor from another commercial venture taking his intellectual property and selling it for a profit. A patent does not prevent a DIY tinkerer from taking part or all of an idea and applying it for his own personal use.

I would say go for it... Not sure if it will work for ya, but who knows??

Depending on how the claims were written I think any DIY'ers would technically be infringing if a patent is eventually issued even if it was just for personal use. With that said I think the odds of Malibu finding those people and taking legal action against them are very low. It would probably cost more money to have the lawyers draw up a cease and desist letter than they would recover from individuals who just added some trim tas to the sides of their boats for their own use.

If they added the actual surfgate system to past and current wake boats for a profit, then yes. A DYI'er adding aftermarket trim tabs to their own boat, No. You can buy those trim tabs and have any local shop install them or do it yourself. How you mount them is up to you, and in no way a patent infringement.
