this is very upsetting

I think that either the teen who was in the house, the parent who left the house, or both should be charged with something

Without more information than found in the article I fail to see that anyone should be charged with anything. The babysitter was old enough to care for children. But I don't think she was old enough to be charged with anything meaningful. It's just one of the things where a 16 year is considered old enough to babysit. But a 16 year old can't be expected to be as competent as an adult.

Very tragic situation. Clearly the 5 year old didn't realize holding the baby under water would kill it. At least I pray to go the 5 year old didn't. Terrible that the 16 year old fell asleep but who would have thought the outcome would be a dead baby.......

With all the people in the world stuff like this is just going to happen. Even if it was the mother that fell asleep I would hate to see her charged. I'm sure the mother is suffering enough. You shouldn't be facing prison for falling asleep.

That is very upsetting.

You can't fall asleep with a toddler running around, OR a 5 year old. That's just the way it is. IT's too bad the baby sitter didn;t understand that.

I sure hope they don't take a 5 year old to trial for murder. That's rediculous. At 5, she won't understand any of it. Drowning, death, none of it will make sense.

Charging anyone in this case benefits no one but the government. Whether it be fines or imprisonment of hte babysitter, or parents, it would only serve to ruin people's lives. The parents are presumably productive working people trying to raise their kids. Charging them would break up the family, present a financial hardship, possibly result in loss of their income, and they would end up with a broken up family and on welfare. This benefits no one except the government.

If the babysitter was charged it would result in a later graduation from high school, ridicule from peers, a great expense for her and possibly her family, and in general hurt her learning and earning potential for years (decades?) to come. This would benefit no one except the government.

it's absurd to charge a 5 year old. She likely didn't fully understand what she was doing or what the end result would be. Give it a few years and it will sink in hard. It will be a guilt she will live with for the rest of her life.

If there was no malicious intent then there is no reason to send anyone to prison, and there certainly isn't any reason why government should profit from this. Sometimes bad things happen and that's the way it is. All involved walk away with some loss and some learning from it.
