Wow, what a bummer. Is your neighbor gonna step up and take care of it for you? Nice setup by the way, do you have any pre-arbor day pics?

-Steve

save both, and get a new neighbor!

99_slaunch 05-02-2006 4:50 PM

His homeowners ins should pay for it.

ord27 05-02-2006 4:52 PM

dont be mad at the neighbor
he's really a nice old guy
they live in that mobile rv that you see in the first pic
I've lived here 5 1/2 years, and they have been home maybe a total of 2 months
they travel the country
he is gunna fix things right...through home owners insurance

ord27 05-02-2006 4:54 PM

I feel lucky that I was home
if my truck had not of been there
the bow might have been smashed

what kind of tree is that, and what are you going to do with the wood

bumm deal, thankfully he's a good guy..... what took the tree out, cutting it down or weather??

ord27 05-02-2006 5:24 PM

fruitless mulberry
not sure
my dad wants me to take it to the lake cabin...at Palestine
the tree guys will more than likely take it

ord27 05-02-2006 5:46 PM

I guess the tree was taken by some weather, but mostly due to no/poor trimming....too much weight

Sorry to say, but in most cases his insurance won't pay. It will be up to your homeowners.

They call that an act of God.

Anyway that is how it is in Alabama.

The only way it could fall on his insurance company is that the guy next door had been warned about the tree being unstable or unsafe.

carcrz 05-02-2006 7:31 PM

They should pay. We had a hail storm that caused damage to all kinds of stuff on dad's house & it paid for all of it - new roof, windows, & gutters. The stucco was okay so he didn't worry about it. I don't wee why they wouldn't cover it. If nothing else, yours should.

damn, I was hoping for some good wood for smoking

05-03-2006 4:29 AM

My neighbors shack burned down with my boat parked in between the houses. My insurance took care of the damages, not the neighbors.

Jory,

Who paid? Your neighbor's insurance or yours?

In most cases when a tree falls, (no matter whos land it is on) it is up to your insurance to cover the damage.

ord27 05-03-2006 6:41 AM

great point on the insurance
we'll see what happens
I would bet that neighbor will honor the cost...even if out of pocket

also, I know that lots of people don't feel this way, but......if the scratches dont completely come out of the truck, I can't see making him pay to repaint what will probably be the whole truck
although it is a nice truck, it's still a truck
...and somewhat of a work-truck at that

the boat on the otherhand....well....that will get put back to perfect (no matter who pays)

thanks for everyones input

boomerang 05-03-2006 7:22 AM

Cliff,
Once you deductible is met, I would have my insurance company fix every thing.

A good thing for him to offer is to pay your deductible.

But he does not have to.

Danny
